The Regulatory Reform (Fire Safety) Order 2005 (RRFSO) makes reference to the definition of the “responsible person” and states:
- In a workplace, the employer is the responsible person if the workplace is under its control.
- In a workplace not under the employer’s control or another premises (where the Order applies), the responsible person is determined by whether the person has control over the premises in connection with the carrying out of a trade, business or undertaking.
- In premises where the above person does not have control over the premises in connection with a trade, business or undertaking then the owner is deemed to be the responsible person.
Therefore in some circumstance the facilities management company could be deemed to be in control of a workplace. However in most circumstances the business owner would be the responsible person.
